Important: This guide is general educational information. Rules, forms, thresholds, fees and due dates can change. Verify current requirements with the official source and obtain advice for your facts.

Start with ownership and a clearance search

Confirm who owns the mark and search for identical or confusingly similar marks. A company name, domain or social handle does not automatically mean the trademark is available.

Select the correct goods and services

Trademark applications use classification by goods and services. The selected class and wording should match actual or intended use. Filing an irrelevant class can waste cost, while missing a core class can leave a gap.

Filing is the start, not the finish

After filing, the application may be examined and objections may require a reasoned response. Accepted marks are published, and third parties may oppose within the legal process. Registration timing therefore varies substantially.

Use the correct symbol and keep evidence

Applicants may use the ™ symbol to indicate a claimed mark. The ® symbol should only be used after registration for the relevant mark and goods or services. Keep invoices, packaging, advertisements and online evidence showing genuine use.

Frequently asked questions

No. The application is examined and may face objections or opposition. The outcome depends on the law, prior rights and the evidence or arguments submitted.

No. Review phonetic, visual and conceptually similar marks, along with relevant classes and related goods or services.
